Citizen R. Juraeva-one of the doctors with many years of experience worked for many years in the Medical Association in Shirin city. Nevertheless, the head of the Medical Association initially supported unfair disciplinary punishments on her and then illegally terminated the employment contract with her at the initiative of the employer.
According to the Trade Unions Federation of Uzbekistan, an employee is not punished twice for one circumstance. But in regard to this case, the number of labor laws was violated by the employer. In particular, when imposing a fine a letter of explanation was not received from a citizen. R. Juraeva was not informed about the order on the imposition of disciplinary punishment in a written way. On top of that, payments which had to be made were not executed by the employer on the day of announcement of the order. Primarily, the institution did not receive the approval of the Trade Union Committee in this case.
In this situation, it is necessary to restore the labor rights of the employee. The head of the Medical Association received a submission on the elimination of these issues. However, after requirements of submission were not met, the Union of Trade Unions of Syrdarya region took legal action to the court.
Finally, within one month and a half, the employee was reinstated to her position on the basis of the decision of Bayaut inter-district court for civil cases and R. Juraeva was paid a total of more than 10 million UZS for the mandatory period of absenteeism and moral damage.
